EB-1C Multinational Managers & Executives

EB-1C is the green card that often follows an L-1A. It requires no labor certification, but the standard is stricter than L-1: the U.S. employer must have been doing business for at least a year, the beneficiary must have worked abroad for a related company in a managerial or executive capacity for one of the preceding three years, and the U.S. role must be genuinely managerial or executive in substance.

HOW WE HELP

What we work on

01

Corporate eligibility

The qualifying relationship between the foreign and U.S. companies, and evidence the U.S. company has been operating—revenue, staff, premises—for at least a year.

02

Managerial or executive in substance

Officers look past titles to what the person actually does: who reports to them, what decisions they make, and how much of their time goes to supervising professionals or managing an essential function rather than doing the work.

03

Consistent records

Organization charts, payroll, job descriptions and the earlier L-1 filings have to agree. Discrepancies between the L-1 petition and the EB-1C petition are a frequent source of RFEs.

04

Timing and the next step

EB-1C is first preference, so priority dates are often favorable. We coordinate the I-140 with the I-485 or consular stage and with any L-1 extension that is still needed.

OUR APPROACH

How the case moves forward

01

Assess

Review the corporate group, the foreign role and the U.S. role against the regulatory definitions.

02

Build

Prepare operational and role-based evidence that matches the earlier filings.

03

Proceed

File the I-140 and coordinate the residence stage.

HOW WE WORK WITH PETITION CLIENTS

Four elements of our approach; specific service terms are set out in the engagement agreement.

We find the strengths, not just file the materials

We do not write from the folder you send us. We go through your record, ask questions and look for evidence you did not know counted.

Guidance on strengthening your record

Where the record is not yet ready and the plan is realistic, we may advise some clients, at no charge, on how to build it legitimately before filing.

Approve-or-refile option

For eligible clients whose signed engagement agreement includes this option, we will prepare and refile a denied petition without an additional attorney fee, subject to the agreed scope and conditions. Government filing fees and third-party costs are not included unless expressly agreed.

RFE responses included

For full-representation petitions, an RFE response is included when specified in the engagement agreement; stand-alone review services are separate.

COMMON QUESTIONS

Questions we hear often

Practical answers to frequently asked questions. Individual circumstances can affect the best course of action.

Is EB-1C the same as L-1A?+
No. The concepts overlap, but EB-1C has its own requirements—including that the U.S. employer has been doing business for a year—and USCIS applies them independently.
Does EB-1C require PERM labor certification?+
No. It is a first-preference category and skips labor certification.
Can a small company qualify?+
Potentially. There is no minimum size, but the smaller the company, the harder it is to show that the beneficiary manages rather than performs the work. Staffing and organization matter.
