O-1 Visa for Extraordinary Ability

The O-1 is a work visa for people with extraordinary ability: scientists, engineers, founders, physicians and, in the O-1B category, artists. It has no annual cap, can be approved for up to three years at a time, and often serves as the bridge while an EB-1A or NIW petition is prepared. The catch is that it must be filed by a U.S. employer or agent, which makes the structure of the petition as important as the evidence.

Where O-1 cases go wrong

The criteria resemble EB-1A—awards, memberships, press, judging, original contributions, scholarly articles, critical roles, high salary—and three must be met. But the standard is applied to the specific work you will do in the United States, and the petition must show that work: a job offer with duties, or for agent-filed petitions, an itinerary of engagements with contracts.

Founders face an extra question. USCIS allows a company the beneficiary owns to petition in some circumstances, but the filing must show a genuine employer or agent relationship and the company's ability to pay. We design that structure before drafting, because fixing it after an RFE is expensive.

Every O-1 also needs a written advisory opinion from a peer group or labor organization in your field. For scientists and engineers this is usually obtained from a professional association; the request has to go out early, with the petition materials, so the opinion matches the case.

WHO IT FITS

Who typically uses O-1

Researchers moving to industry or a new institution

Postdocs and scientists who have outgrown J-1 or cap-subject H-1B options, or whose employer wants a faster, uncapped alternative.

Founders building a U.S. company

Entrepreneurs who need to work for their own startup while an immigrant petition is prepared.

Engineers and specialists missed by the H-1B lottery

Professionals with a documented record of recognition and an employer willing to petition.

Physicians and clinicians

Doctors with research or clinical achievements, where O-1 may sit alongside licensing and other immigration steps.

HOW WE HELP

What we work on

01

Matching the evidence to the work

We identify the three or more criteria your record meets and tie each to the position or engagements you will hold, so the officer sees extraordinary ability in the same field as the job.

02

Petitioner and structure

U.S. employer, U.S. agent, or your own company: we choose the arrangement the facts support, prepare the employment or agency agreements and, for founders, the corporate records that show the company is a real employer.

03

Advisory opinion and itinerary

We request the consultation letter from the right organization and, for multi-engagement petitions, build the itinerary with contracts and dates that match the petition.

04

Planning the next step

O-1 is a nonimmigrant visa. We advise from the start on how it connects to EB-1A or NIW, including timing, travel and the effect of a pending immigrant petition.

OUR APPROACH

How the case moves forward

01

Evaluate

Review achievements, the intended U.S. work and who can petition.

02

Structure

Confirm the petitioner, draft agreements and request the advisory opinion.

03

Petition

Assemble the evidence, file, and respond to any request for evidence.

HOW WE WORK WITH PETITION CLIENTS

Four elements of our approach; specific service terms are set out in the engagement agreement.

We find the strengths, not just file the materials

We do not write from the folder you send us. We go through your record, ask questions and look for evidence you did not know counted.

Guidance on strengthening your record

Where the record is not yet ready and the plan is realistic, we may advise some clients, at no charge, on how to build it legitimately before filing.

Approve-or-refile option

For eligible clients whose signed engagement agreement includes this option, we will prepare and refile a denied petition without an additional attorney fee, subject to the agreed scope and conditions. Government filing fees and third-party costs are not included unless expressly agreed.

RFE responses included

For full-representation petitions, an RFE response is included when specified in the engagement agreement; stand-alone review services are separate.

AT A GLANCE

Which one are you looking at?

The three are not interchangeable. Many researchers end up filing two of them, in sequence or together; the first conversation is usually about which.

COMMON QUESTIONS

Questions we hear often

Practical answers to frequently asked questions. Individual circumstances can affect the best course of action.

Can I sponsor myself for an O-1?+
Not personally. The petitioner must be a U.S. employer or agent. A company you own may be able to petition if the relationship and the company's operations support it; that is a structuring question we address first.
Is O-1 a green card?+
No. It is a temporary work classification, initially up to three years with extensions. Many O-1 holders pursue EB-1A or NIW in parallel.
Does a pending green-card petition hurt an O-1?+
Generally no. O-1 does not require you to prove you will return abroad, and immigrant intent is usually not a bar. Travel and status questions still deserve case-specific advice.
How is O-1 different from H-1B?+
No lottery, no annual cap, no prevailing-wage filing, and a higher evidence standard. O-1 is also tied more tightly to the specific work and employer named in the petition.
Can my family come with me?+
Spouses and unmarried children under 21 can apply for O-3 status. O-3 does not include work authorization.
Is responding to an RFE included in the fee?+
For full-representation cases where the engagement agreement includes RFE representation, the agreed response work is included. Stand-alone consultations and review-only services do not include RFE drafting or filing.
What is the approve-or-refile option?+
This option is offered to certain eligible clients if expressly included in their signed engagement agreement. For covered denials, we refile within the agreed scope without an additional attorney fee; government and third-party fees remain separate unless agreed otherwise.
RESEARCH-BASED IMMIGRATION

We read the work. Then we build the case.

For research-focused NIW, EB-1A and O-1 matters, we examine achievements, their documented significance and the legal criteria. Independent use of an applicant’s work can be helpful evidence, but no single metric determines eligibility.

We read the citing papersNot just the count: who cited you, whether they are independent of you, and what they built on your work.
We look for what you have not documentedReviewer invitations, adoption by other groups, talks, patents, industry use: strengths most researchers leave off the CV.
Gaps come firstYou get a list of what is missing before filing and, for some clients, guidance at no charge on how to fill it legitimately.
One story across every documentThe endeavor and the facts match in the petition letter, your statement and each recommendation letter, because officers compare them.
Letters with distinct voicesWriters with different relationships to your work, each pointing to exhibits, none of them interchangeable.
RFE support & selected-client refilingRFE representation depends on the full-service engagement; approve-or-refile is a real option for selected eligible clients under their written agreement.
